We will deliver our services in a timely manner with a minimum of fuss. At Instinctive we aim to deliver a consistently high quality of work and service.

You will receive fully edited digital images via our secure password protected online gallery within 3 days unless otherwise specified, same day service also available upon request.

We are also happy to use your preferred digital transfer such as we-transfer & dropbox.

Instinctive by name, instinctive by nature. We work with national brands and small businesses and are happy to react and guide you in your requirements.

Images are watermark free, all we ask is that you credit our photography in publications and media where reasonably possible.

If we are shooting for your business and visiting your clients, we will at all times represent your company in a friendly and positive manner.

We believe in rewarding loyalty and the more customers use us, the more flexible we become with our time giving even greater value for money!

We have no hidden charges and do not charge for images licences or localised travel. Prices are based on our time on site to serve you. Email or call us to enquire.


Payment Terms

Private Customer

All sessions to be paid for at time of booking via bank transfer, unless otherwise agreed, which may be the case for repeat & frequent private customers.

New Commercial Customers

Frequent Commercial Customers

Frequent customers who return to us several times a year will be invoiced at the end of each session, with invoices being payable within 14 days of the invoice date via bank transfer.

Government Dept, National Trust Procurement & others who are specifically limited to monthly billing.

30 day billing will only be offered to large nationals or by special agreement to long standing, loyal customers

A purchase order must be issued prior to any work being carried out.

Payments must not exceed 30 days.

If you would like us to work with your business and can commit to several days work a month on a rolling basis, then you could benefit from volume related discounts.

Wedding Payments


We do not ask for deposits for wedding photography, all we do ask is that your invoice is paid one month prior to your Wedding.


Payments via bank transfer.


Method Statement



1) Ensure all kit is ready, charged and in good condition for the project.

2) Ensure backup equipment is on hand, memory cards, batteries, camera.

3) Carry equipment in recommended cases and bags during transit.

4) Agree start times with client and plan travel routes and times with time to spare.

5) Arrive to site in good time and make contacts aware that I’m ready for work, where

present.

6) Interact with everyone I come into contact with in a friendly and professional

manner. Customers, models. general public and other photographers.

7) Carry out the session as per the customer brief (where brief given)

8) Check shots and progress by reviewing images for quality as I shoot.

9) Act in the safest way possible, as per my Risk assessment and report anything that

becomes a concern to me to those on site, if present.

10) Return to office, upload images to Lightroom and back up files.

11) Edit images within the agreed time frame and deliver to customer via password

protected online gallery.

12) Check customer has received and dowloaded all files safely to one or more

computers before removing transfer gallery from my own files.

Our images are only stored a few months, please keep your images safe.

GDRP (General Data Protection Regulation)


It is the venue, business or events responsibility to ensure they adhere to GDPR and gain consent for anyone to be photographed.

We will also ask people ourselves and check that consent has indeed been given.

It is the customers responsibility to ensure images are stored safely and we do not retain clients images for longer than is needed to provide our service.

Our website galleries are password protected for the viewing of clients only.

Any images used within are media are done so with kind permission of our customers.

Should anyone have a change of circumstances or wishes to remove consent for sharing of images, we will do so without question and in a timely manner.


Please respect other peoples privacy rights.

For example: If booking headshots for staff, do not assume staff will be happy to give consent.

People should not have to give a reason for refusing, there are many private or personal reasons why a person may refuse.


Storage of information


Please be aware:


We do not store images longer than we need to serve the customer.


We do not collect email addresses in order to mail shot customers.


We do not save personal information such as addresses or phone details for longer than needed to serve the customer.


We do not directly accept credit or debit card payments.


We will never share your details with a third party.


PLEASE ENSURE TO KEEP YOUR IMAGES SAFE AND SECURE AS WE DO NOT OFFER LONG TERM IMAGE STORAGE








Discrimination or Prejudice

We will not tolerate discrimination or prejudice of any kind..

We refuse to work with, participate or work for anyone who makes inappropriate comments, remarks, sexual, sexist, racist or other towards any other person or group.



Health & Safety - Risk Management.


We reserve the right to leave any session where we deem the environment to be unsafe.

This may be risks from falls or trips, chemicals, dust, machinery, transport or persons behaving in a manner that could cause harm.

Our policy for Child models or Vulnerable adults in Photographs or Videos

Child Consent


The Customer / Venue / Business or Organisation must gain "parental" consent of any child to be photographed or filmed.

It is their responsibility to ensure the parents & children are aware that the images may be shared or published. If consent is granted by a parent and the child does not wished to be photographed then we will respect the child's decision and not pressure them to participate. Nor will we allow a child to be forced to participate by anyone else.

We reserve the right to cancel the session if a child is not happy within their situation.

Child Supervision


All children must be supervised by their parent or guardian at all times.

It is their responsibility to ensure a child is always within sight and in a safe environment. We do not recommend the child being left alone with people they don't know, however brief this may be. We also reserve the right to call an end to our services if parents or guardians place the child under any pressure, anxiety or distress to participate, or encourage actions that may cause harm to the child. We will not tollerate any shouting, swearing or bullying of children during our sessions.

Any poor behaviour or aggression towards a child will be reported.


Child Dress code


We will not partake in any photography or film where a child or minor is dressing in a manner that we deem as inappropriate for their age.

We will not assist or help with any clothing changes or hands on posing of infants or minors. This must only be done by parents, supervised designated stylist or by themselves if able to do so.

We do not recommend the child being left alone with people they don't know for costume changes or other. We reserve the right to call a close to any children's photography session if we believe the child is becoming distressed or deem the child to be in an unsafe or unhappy environment, both physically or emotionally.




Child Image Storage & Sharing


We will only store images long enough to pass them to the client.

It is the clients responsibility to ensure they keep the images safe for the future.

We will only share images to our Instinctive media feeds of children with the consent of the parent or via shared button from a clients / venues previous public post. Should anyone have a change of circumstances or wishes to remove consent for sharing of images, we will do so without question and in a timely manner.

When asking for consent.

We will only accept consent that is given by a parent and will ask for evidence that this has been granted,

A family member, teacher or other may not assume consent would be granted by a parent.

The child always reserves the right to NOT be photographed.

NO ONE SHOULD EVER BE ASKED WHY THEY REFUSE TO GIVE CONSENT, OR PRESSURED TO DO SO.

Vulnerable Adults

If requested to photograph someone who does not have the mental capacity or communication skills to make their own consent wishes known. Then we would require permission from a family member or guardian.



Filming contract Terms document


Terms


  • A non-refundable deposit of 50% is due prior to filming or lengthy production briefs.
  • Filming and post production work will be completed.
  • Client to review draft edit for tweaks or approval.
  • One round of tweaks & amendments can be made.
  • Subsequent revisions or significant re-edits will incur additional costs for time.
  • Remaining 50% payment due upon completion of final draft.
  • Client will receive the ‘finished product Download’ upon payment.


It is the clients responsibility to ensure they communicate in writing all key shot lists and requirements.


Client understands that contract must be signed and deposit amount must be payed prior to work commencing.


Client understands final payment for the project is required in order to release the final product download.


In the event of filming being delayed, aborted, disrupted by the client or their associates without reasonable notice, this lost time will in most cases be chargeable.


If at any time the client desires to make changes or variations to the delivered finished product, such changes will incur further reasonable costs.


Weather may cause disruption to some shoots, let’s all work together to ensure we are proactive in dealing with potential disruption from adverse conditions.

TERMS OF AGREEMENT:

1. Customer is responsible for Food and Hot / Cold drinks YES NO 2 Customer is responsible for parking / travel cost YES NO

3. The deposit is non refundable if the client cancels the Photoshoot, if the Photographer fails to appear at the place and time as specified above, the price of this Photoshoot will be refunded in full.

4. The customer will assist and cooperate with the Photographer in obtaining the desired Photographs, including but not limited to specifying persons or scenes to be photographed and taking time to pose at the Photographers direction. The Photographer shall not be responsible for Photographs not taken as a result of the customers failure to give reasonable assistance or cooperation.

5. The Photographer retains copyright on the Photographs and hereby grants the client unlimited but not exclusive rights to use or reproduce the Photographs.

6. The Photographer can not be held responsible for very poor weather, which may or may not effect travel to the Venue or the results of the desired Photoshoot.
